Proxyoku ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. We comply with the provisions of the Digital Millennium Copyright Act (DMCA) and international copyright laws.
1. Proxyoku's Role as a Neutral Conduit
It is important to understand the technical nature of our service. Proxyoku operates as a transient web proxy. We provide a tool that allows users to route their internet requests through our servers to access third-party websites.
Because of this technical architecture:
- We do not host files: We do not upload, store, or host any movies, music, software, or copyrighted files on our server hard drives.
- We do not control destination content: We do not operate or control the third-party websites that users choose to visit through our proxy tool.
- We are a conduit: Data accessed through our proxy is processed temporarily in our server's RAM solely to transmit it to the user's browser and is destroyed when the session ends.
As such, we qualify for the safe harbor protections under Section 512(a) of the DMCA (Transitory Digital Network Communications). We cannot permanently delete a file from the internet, as it does not exist on our servers.
2. How to Submit a Copyright Infringement Claim (DMCA Notice)
If you are a copyright owner, or authorized to act on behalf of one, and you believe that your copyrighted work is being actively and consistently accessed via our proxy network without authorization, you may submit a formal DMCA takedown request.
Please note that because we do not host the file, the most effective action we can take is to blacklist the specific offending destination domain (URL) from our proxy routing network.
To request a domain blacklist or report an infringement, please send an email with the following required information:
- Identification of the Work: A description of the copyrighted work that you claim has been infringed.
- Identification of the Infringing Material: The exact URL(s) or domain(s) of the third-party website where the copyrighted material resides, which you are requesting us to block from our proxy network.
- Your Contact Information: Your full name, mailing address, telephone number, and email address.
- Statement of Good Faith: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
3. Where to Send Your Notice
Please submit all DMCA notices and copyright infringement claims directly to our designated abuse team via email:
Email: [email protected]
(Please include "DMCA Notice" in the subject line of your email to ensure prompt processing).
4. Counter-Notice Procedures
Because Proxyoku does not host user-uploaded content, standard DMCA counter-notices (where a user disputes a file takedown) generally do not apply to our infrastructure. If a domain is blocked by our network administration team due to copyright abuse, it is done at our sole discretion to protect our network integrity.
5. Repeat Infringers and Network Abuse
In accordance with the DMCA and other applicable laws, Proxyoku enforces a strict Acceptable Use Policy. If we determine that a specific IP address or user is utilizing our proxy network specifically to bypass copyright protections or engage in repeated piracy, we reserve the right to permanently block their access to our Service without notice.
